Welcome to Clarity Health, a mobile application service (“Clarity Health,” “Clarity Health app,” or “Service”) operated by Clarity Health Project (“We,” “Us,” or “Our”), a mission-driven organization dedicated to empowering individuals to access, understand, and manage their personal health information through technology.

  • Clarity Health empowers you to access, better understand, and engage with your personal health information, with help from CLaiR, your private, friendly AI health assistant.
  • Your health information is encrypted and stored locally on your device. When you interact with CLaiR, your information may be temporarily and securely processed by our servers but is never stored permanently.
  • We do not sell, mine, profile, or use your health information for AI training. You control your data and who, if anyone, you choose to share it with.
  • Your privacy rights, including GDPR protections, are fully respected. You have the right to access, delete, and control your personal information.

How Clarity Health Works

Collecting Your Health Information

  • Using the Clarity Health app, you can request copies of your health information from healthcare providers who offer patient portals or participate in electronic health records (EHR) systems.
  • To retrieve your records, you will enter the username and password you use for your healthcare provider's portal directly into a secure login window.
  • We do not have access to, store, or retain your usernames or passwords.
  • We do not control third-party healthcare systems and cannot guarantee the availability, completeness, or accuracy of information retrieved from them.

Storing and Interacting with Your Health Information

  • Once you retrieve your health information, the Clarity Health app encrypts and stores it locally on your device.
  • When you interact with CLaiR, your health information may be securely and temporarily processed through our servers to provide personalized explanations and insights.
  • However, this data is deleted from our servers immediately after the interaction concludes.
  • We do not store, use for training, or share your Health Data without your expressed consent.
  • You can delete your health information at any time through the app Settings or by uninstalling the app from your device.
  • Deleting the app or clearing your data will remove all locally stored health information, but does not affect your healthcare providers' systems.

Sharing Your Health Information

  • The choice to share your health information is always yours.
  • Clarity Health may enable you to share your records or insights with third-party services only if you explicitly choose to do so.
  • We are not responsible for how third-party services handle your shared information once it leaves the Clarity Health app.

Terms and Conditions

Limited License

We grant you a personal, limited, non-exclusive, revocable license to download, install, access, and use the Clarity Health app and its associated technologies (the “Technologies”) solely for managing, understanding, and optionally sharing your health information.

User Restrictions

  • Only individuals eighteen (18) years or older may use the Clarity Health Service.
  • If you are accessing the app outside the United States, you are responsible for complying with local laws and regulations.

Authorizations

By using Clarity Health, you authorize us to:

  • Help you exercise your right to access your personal health information.
  • Provide CLaiR's explanations and insights based on your health information.
  • Temporarily and securely process your health information during CLaiR interactions without storing it permanently.

Acceptable Use

  • You agree to use the Service only for lawful, personal purposes related to managing your health information.
  • You agree not to misuse, hack, interfere with, reverse-engineer, resell, or otherwise use Clarity Health for unauthorized, illegal, or harmful purposes.

Right to Restrict Access

We reserve the right to suspend, restrict, or terminate your access to the Service for violations of these Terms or at our discretion, although we will strive to provide reasonable notice whenever possible.

Intellectual Property

  • We retain ownership of all intellectual property rights in Clarity Health and CLaiR, including designs, logos, software code, trademarks, and documentation (“Clarity Health IP”).
  • You may not copy, modify, sell, lease, reverse-engineer, or otherwise misuse Clarity Health IP.

Third-Party Systems

We are not responsible for the systems, portals, or records operated by healthcare providers or any third-party applications you may choose to connect to or share information with.

Privacy

These Terms incorporate by reference our Privacy Policy, which governs how we collect, use, and protect your information.

Protecting Your Information

  • You are responsible for protecting access to the Clarity Health app and your device, including using strong passwords, device encryption, and securing your login credentials.
  • We encourage you to use biometric authentication (like Face ID or Touch ID) where available.

Changes to the Terms

  • We may update these Terms periodically. If changes are made, we will update the “Last Updated” date at the top of this page.
  • By continuing to use Clarity Health after changes become effective, you agree to the updated Terms.

Important Legal Information

Disclaimers

  • The Clarity Health app and Services are provided “as is“ and “as available“ without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We do not guarantee that the Service will meet your needs, be error-free, or improve your health outcomes.
  • Your use of the Service is at your own risk.

Limitation of Liability

  • To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of goodwill, or health outcomes, arising out of or relating to your use of Clarity Health.
  • If your jurisdiction does not allow such exclusions, our liability will be limited to the maximum extent permitted.

Jurisdiction and Governing Law

  • If you need to bring legal action against us, you agree to do so exclusively in a court located in New York County, New York, under the laws of the State of New York and applicable U.S. law.
  • Any claims must be filed within the applicable statute of limitations or, if earlier, within one year after the facts giving rise to the claim could have been discovered.

Class Action Waiver

You agree that any disputes with us must be resolved individually and you waive your right to participate in any class or collective actions.

Waiver and Severability

  • Our failure to enforce any provision of these Terms is not a waiver of our rights.
  • If any provision is found invalid or unenforceable, it will be severed without affecting the rest of the Terms.
